1. Acceptance of Terms
By accessing or using the DollarMates website (the “Site”) or any DollarMates product or service, you agree to be bound by these Terms & Conditions (the “Terms”). If you do not agree to the Terms, you must not access or use the Site. We may require you to accept updated Terms before you continue to use certain features.
2. Eligibility
You must be at least 18 years old and capable of forming a legally binding contract to use the Site or register for a DollarMates product. By using the Site, you represent and warrant that you meet these requirements. We may refuse, suspend, or cancel access for any person at our discretion, including where we reasonably believe these eligibility requirements are not met.
3. Licence to Use the Site
Subject to your compliance with these Terms, DollarMates grants you a limited, non-exclusive, non-transferable, and revocable licence to access and use the Site for your own personal or internal business purposes. This licence does not include any right to resell, sublicense, copy, or commercially exploit any part of the Site without our prior written consent.
4. Acceptable Use
You must not, and must not attempt to:
- use the Site for any unlawful purpose or in a way that breaches any applicable law;
- gain unauthorised access to the Site, our systems, or another user’s account;
- introduce any virus, malware, or other harmful code;
- scrape, harvest, or systematically extract data from the Site;
- interfere with, disrupt, or place an unreasonable load on the Site’s infrastructure; or
- impersonate any person or misrepresent your affiliation with any person or entity.
We may investigate suspected breaches of this clause and take any lawful action in response, including suspending or terminating your access under clause 10.
5. Intellectual Property
All content on the Site — including text, graphics, logos, product names, software, and design — is owned by or licensed to DollarMates Pty Ltd and is protected by Australian and international intellectual property laws. Nothing in these Terms transfers any intellectual property right to you. You must not reproduce, modify, distribute, or create derivative works from any part of the Site without our prior written consent.
6. Third-Party Links
The Site may contain links to third-party websites or services that are not owned or controlled by DollarMates. We do not endorse, and are not responsible for, the content, accuracy, or practices of any third-party site. Your use of a third-party site is at your own risk and subject to that site’s own terms and policies.
7. No Warranties
To the extent permitted by law, the Site and all related content and services are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, or accuracy. We do not warrant that the Site will be uninterrupted, secure, or error-free. Nothing in this clause excludes, restricts, or modifies any consumer guarantee under the Australian Consumer Law that cannot lawfully be excluded.
8. Limitation of Liability
To the maximum extent permitted by law, DollarMates excludes all liability for any indirect, special, incidental, or consequential loss or damage (including loss of profits, revenue, data, or goodwill) arising out of or in connection with your use of the Site, however caused. Where our liability cannot be excluded, our total aggregate liability to you for any claim arising out of or in connection with these Terms or your use of the Site is limited, at our option, to resupply of the relevant service or one hundred Australian dollars (AUD $100), whichever is greater.
Nothing in these Terms excludes, restricts, or modifies any right, remedy, or consumer guarantee that you have under the Australian Consumer Law, or any other right that cannot lawfully be excluded, restricted, or modified.
9. Indemnity
You agree to indemnify and hold harmless DollarMates, its officers, employees, and agents from and against any claim, loss, liability, damage, or expense (including reasonable legal costs) arising out of or in connection with your use of the Site, your breach of these Terms, or your violation of any law or the rights of a third party.
10. Suspension & Termination
We may, at our sole discretion and without notice, modify, suspend, or discontinue any part of the Site, or suspend or terminate your access to it — including where we reasonably believe you have breached these Terms, engaged in fraudulent or unlawful conduct, or where required by law. Except as required by law, we are not liable to you for any modification, suspension, or termination carried out in accordance with this clause.
11. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. The updated Terms will be posted on this page with a revised “Last updated” date. Your continued use of the Site after an update takes effect constitutes your acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of Australia. You irrevocably submit to the non-exclusive jurisdiction of the courts of Australia in respect of any dispute arising out of or in connection with these Terms.
13. Severability & Entire Agreement
If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect. These Terms constitute the entire agreement between you and DollarMates regarding your use of the Site, and supersede any prior agreements or understandings, whether written or oral.
